The fine print, written like a human.
If something here is unclear, ask before you book.
1. Who you are dealing with
Skybreaker Overland Ltd., a British Columbia company. GST/HST No. 771062023RT0001. PST No. PST-1490-2541. Contact hello@skybreakeroverland.com.
In these terms, "we" and "us" means Skybreaker Overland Ltd. "You" means the person booking, and everyone travelling under that booking.
2. What these terms cover
These terms apply to everything we sell: guided trips, self-guided trips, long-distance expeditions, driver training, and consulting work.
They sit alongside two other documents. Where a vehicle is involved, our Rental Agreement governs the vehicle. Every participant signs a waiver before departure. If any of those conflict with this page, the signed document wins.
We may update this page. The version in force is the one published on the date you paid your deposit. Ask us for a copy of that version any time.
3. Bookings and deposits
A booking is confirmed when your deposit is received and your contract is signed. Not before. Dates are not held on a verbal or an email.
A deposit of 50% confirms your booking. The balance is due 60 days before your start date.
If the balance is not received by the due date, we may release your dates and treat the booking as cancelled by you, under section 5.
Licences are verified and orientation is completed before keys change hands. No exceptions.
4. Money
All prices are in Canadian dollars. GST, PST and credit card or wire funds transfer processing fees are extra where they apply.
Prices shown on our website as "from" are starting figures, not quotes. A quote is valid for 14 days from the date we send it.
Overdue amounts carry interest at 1.5% per month, being 19.56% per year. You are responsible for reasonable costs of collection.
Starting a chargeback on a service we have delivered is a breach of these terms. You remain responsible for the amount plus our costs.
5. If you cancel or move your dates
Booked trips are not refunded. Deposits are not refunded.
What you have paid carries forward as a credit to new dates, valid for 12 months from your original start date, subject to availability. If the new dates cost more, you pay the difference. Unused credit expires at 12 months.
Tell us as early as you can. The earlier you move, the more likely we can give you the dates you want.
If you shorten a trip, leave early, or a member of your party drops out after the balance is due, the price does not change.
6. If we cancel or move your dates
We may cancel, shorten, reroute or reschedule for reasons outside our reasonable control. That includes wildfire, flood, storm, washout, road or ferry closure, border closure, labour action, government order, public health measure, and mechanical failure that takes the vehicle out of service.
When that happens, everything you have paid carries forward as a full credit to new dates, under the same 12-month terms as section 5. We do not issue refunds.
We are not responsible for what you spent around the trip. Flights, hotels, time off work, gear. That is what travel insurance is for. See section 18.
A change to the route, the campsites or the itinerary is not a cancellation. See section 7.
7. Routes change
Our routes are planned, not guaranteed. Road conditions, fire bans, seasonal access, permits, weather and water levels all move. We will reroute when we need to.
On a guided trip, the guide has final authority on route, timing, camp selection, and whether an obstacle or section is attempted. Decisions made for safety are not grounds for a refund or a credit.
8. The season
We operate year round.
9. What is included
Your invoice lists what is included. Anything not listed is not included. That normally means personal gear, alcohol, travel to and from the start point, and gratuities.
10. Drivers
This applies to self-guided trips and any trip where you drive.
Every driver must be named in the Rental Agreement, be at least 25 years old, and hold a valid full licence in their possession with any required air brake endorsement. We do not accept learner permits, graduated licences, or N licences.
Only named drivers may operate the vehicle. Putting an unnamed driver behind the wheel voids your coverage and forfeits your security deposit.
The truck is large, heavy and handles nothing like a car. It needs more room above, in front, behind and beside it than you think. Use a spotter when reversing.
Orientation is mandatory before keys are released. Completing orientation does not mean we have assessed your competence to drive it.
11. Security deposit
A refundable security deposit of $10,000 CAD is taken at pick-up.
It comes back within 14 days once the truck checks out. That means returned clean, fuel tank full, holding tanks emptied at a designated station, garbage offboarded, no damage, and nothing outstanding.
If the deposit does not cover what is owed, the balance is due immediately and we may charge the card on file.
12. Insurance and the deductible
We carry commercial insurance that follows the truck onto gravel, forest service roads and deep backcountry as routed.
In a claim, your financial responsibility is capped at the deductible of $10,000 CAD, provided you were operating within these terms and the Rental Agreement.
If you breached those terms, the cap does not apply and you are responsible for the full claim.
Two things are never covered, whatever the circumstances. Damage to the roof from contact with an overhead obstruction. Damage from water crossings.
13. Where the truck can go
Gravel, forest service roads and deep backcountry are included. There are no kilometre caps.
Off-road use is permitted where all of the following are true.
- The route is legal to access, or you have the landowner’s written permission.
- It has enough width and clearance for the truck.
- The grade does not exceed 55%.
- Conditions allow you to get back out again.
On public roads the limit is the lesser of 90 km/h, the posted limit, or the speed a prudent operator of a heavy vehicle would use in the conditions.
The truck stays in Canada and the United States.
14. What you cannot do
These are breaches of contract, not adventure. Any one of them forfeits your security deposit and may end your trip on the spot with no refund or credit.
- Racing, jumping, or deliberately abusing the vehicle.
- Water crossings of any depth, unless instructed by a Skybreaker Overland guide.
- Driving impaired by alcohol, cannabis or anything else.
- Carrying anyone not named on your booking.
- Anyone on the roof.
- Driving without seatbelts.
- Smoking inside the truck, which also carries a $1,000 cleaning and replacement charge.
- Pets without our written consent.
- Dumping grey or black water anywhere but a designated station or accepted location.
- Using the truck commercially, including carrying paying passengers.
- Taking the truck outside Canada or the United States.
- Giving us false information to get or extend a booking.
15. Damage, breakdown and recovery
Tell us immediately if something breaks or you have an incident. Accidents must be reported to us within 24 hours, and theft or vandalism must be reported to police, with a copy of the report to us. No police report, no insurance claim.
Repairs under $200 you can authorize yourself. Keep the receipts. Repairs over $200 need our authorization first.
We reimburse repairs that trace back to the truck not being roadworthy when you took it. We do not cover your hotel, meals or onward travel when something breaks.
Tickets, citations and tolls are yours, plus a $50 administration fee per item.
Late return is charged at the daily rate in your Rental Agreement, plus our costs to recover the truck and any losses caused to the next booking.
16. Cross-border travel
Getting into the United States is your responsibility, for every person on the booking.
Valid passports, visas, permits and entry eligibility are on you. A past criminal record, including an impaired driving conviction, can bar entry to the US even decades later. Check before you book, not at the booth.
You must tell us before you pay a deposit if anyone on the booking has previously been denied entry to the United States, or has a record that could result in denial.
If anyone is refused entry, for any reason, the trip is treated as cancelled by you under section 5. You get a credit, not a refund, and onward travel is at your cost.
You are responsible for declaring goods and for all duties, taxes, fines and seizures. Do not carry firearms, ammunition, cannabis in any form, prohibited food or plants, or undeclared alcohol across the border.
We are not responsible for time lost to border processing, inspection or closure.
17. One-way and long-distance expeditions
Trips that do not finish where they started carry a repositioning fee, quoted per trip and shown on your invoice. It covers returning the truck: crew time, fuel, ferries and accommodation. It is not refundable once the trip starts.
On remote sections there may be no cell coverage, no towing, no fuel, no medical services and no timely search and rescue. Satellite communication is carried but is not guaranteed to work. Help can be days away, not hours.
The cost of medical evacuation, vehicle recovery, towing and repatriation in remote areas is yours, whether you arrange it, we arrange it for you, or authorities do.
If a vehicle is abandoned, you are responsible for all recovery and transport costs, plus lost revenue for the period the truck is out of service.
18. Travel insurance
We strongly recommend travel, medical and trip-cancellation insurance with emergency evacuation coverage, and we can introduce you to Global Rescue through our partner arrangement.
We are not an insurance broker and we do not advise on coverage. Read the policy yourself and confirm it covers off-road travel, remote evacuation and the country you are travelling in. We are not responsible for what your policy does or does not pay.
Since we do not refund, insurance is the only thing that protects your money if you have to cancel.
19. Driver training
Training requires a valid full licence and any endorsement listed on your booking. Prerequisites are set at booking and are not waived on the day.
On our dedicated training courses we issue a record of completion. That record confirms you attended and completed the course. It is not a licence, it is not a professional certification, it does not certify your competence to operate any vehicle, and it does not qualify you to drive commercially. Trips that include training as part of the package do not carry a completion record.
The instructor may end any participant’s session at any time on safety grounds, with no refund.
Damage caused by a participant disregarding instruction is charged to that participant under section 15.
Sessions we cancel for weather or ground conditions are rescheduled, not refunded.
20. Consulting and advisory work
The scope is what is listed on your invoice or statement of work. Anything else is a new engagement, quoted separately.
Timelines assume you provide access, information and approvals when we ask. Delay on your side does not reduce the fee.
Frameworks, templates, tools and methods we bring to the work remain ours. Once you have paid in full, you get a perpetual, non-exclusive licence to use the deliverables inside your own business. You may not resell, sublicense or publish them.
Each side keeps the other’s non-public information confidential.
Advice is based on what is known at the time. We do not guarantee any commercial, financial or regulatory outcome, and we do not give legal, accounting, tax or insurance advice.
Either side can end the engagement on 14 days’ written notice. Work done to that date, and third-party costs already committed, remain payable.
21. Risk
Backcountry travel carries real risks. Remote terrain, wildlife, weather, and roads that don’t apologize. Mechanical failure far from help. Limited or absent emergency services, communications and medical care.
You accept those risks for yourself and everyone on your booking. Every participant signs a waiver before departure, and the waiver sets out the risks in full.
You must tell us in writing, before departure, about any medical condition, medication, allergy or mobility limit that affects participation. If something you did not disclose causes an evacuation or ends the trip, the cost is yours.
22. Conduct
We can remove anyone whose behaviour, impairment or disregard for instruction puts people, property or the vehicle at risk. No refund, no credit, and getting home is at your cost.
23. Limitation of liability
To the maximum extent the law allows, our total liability for any claim connected to your booking is limited to the amount you actually paid us for it.
We are not liable for indirect or consequential losses. Lost time, missed flights, accommodation, lost earnings.
Nothing in these terms limits liability that cannot be limited by law.
24. Indemnity
You agree to indemnify us against claims, losses and expenses arising from your use of the vehicle or your participation, including claims brought by anyone travelling on your booking. Where more than one person is named on a booking, this obligation is joint and several.
25. Photography
We photograph and film our trips and use that material in our marketing. Tell us in writing before departure if you would rather not appear.
26. Privacy
We collect personal information only to deliver the service and meet our legal obligations. See our Privacy Policy.
27. Governing law
These terms are governed by the laws of British Columbia and Canada. Any dispute goes to the courts of British Columbia sitting in Victoria.
If any part of these terms is unenforceable, the rest stands.
These terms, together with your signed Rental Agreement, waiver and invoice, are the whole agreement between us.
28. SMS messaging
By submitting a form and checking the SMS consent box, you consent to receive texts from Skybreaker Overland about your inquiry, booking, and trip. Message frequency varies with your trip activity. Message and data rates may apply. Reply STOP to unsubscribe, HELP for help, or contact hello@skybreakeroverland.com. Consent is not a condition of purchase. We do not sell or share your number for third party marketing.
